    getting a new car in chapter 13

    I have a leased vehicle and it was not included in the 13, the lease will be up in 6 months.......in the meantime., my mom was going to cosign when the time came for the lease to be up for a new vehicle or put it in her name., etc., our attorney said that would be fine to do and the trustee would approve me paying her.. Anyone else run into this? I want to get another new vehicle., as I will be paying on it for the 13 term.
    I just wanted to make sure the trustee wouldn't frown on me turning in my lease 6 months early as there is no penalty for that with my lease contract and if I wait 6 months my mom will not longer be working .

    If your attorney advised you it is fine, it is fine...we cannot tell you that a trustee would say anything different if your attorney said it is OK. You need to ask your attorney that question (if the trustee would frown on it). I see two red flags...your mother co-signing for you is one and your mother not working in six months is number two. If for some reason you cannot continue to make payments on that lease if your mother co-signs for you, it is her responsibility to pay. If she will be out of work in six months, it doesn't take too much to figure out you could have a bad situation. Better think this one out and discuss with your attorney in more detail.
