    Vehicle Surrender

    I did a search on the topic, but I'm not able to find anything specific to my situation. Here's the skinny:

    Filed Chpt 13 in May 2009
    Paperwork shows surrender of 2nd vehicle
    2nd vehicle was used as collateral for a loan with Citi.
    Citi never filed a claim against me (I'm paying 100% in Chpt 13 plan) within the alloted time period.
    The car is STILL sitting in my driveway!!!

    I asked my attorney's office about it back in September, but they said the bank will address the issue. They haven't! What am I supposed to do? I'm sick of looking at it. It's a piece of junk and I want it gone!

    Any advice would be appreciated. TIA

    If your lawyer approves, you can contact your bank and arrange a specific time and place to surrender the car. Be sure you get a receipt for it.

    Again if your lawyer approves, you could drive/tow the car to the bank, go in and tell them you are surrendering the car, the car is out in the lot, get a receipt for it, and go home

      I"m in a similar situation. My car has been "surrendered" for about 6 months. However, the bank has yet to come get it. It's un-drivable, plus, the bank that owns it is somewhere on the east coast (I'm in the midwest), so I can't very well drive it there.

      You'll have to contact your banks repo department. That's what I did. If they do the same thing that my bank does, they'll have you fax what's wrong with your car to them, then they'll "decide if they're going to come get it."

      I'm still waiting to hear back. The thing is, if the don't come and get it, then what? I mean, I can't very well just junk it (I don't have the title, nor do I own it). But, I can't really afford to have it shipped to them either.

      My attorney said that if they refuse to come get it, then we'll tell them that we're going to either start charging them a storage fee, or we'll go park it in a WalMart parking lot.
