    Company Funded Retirement Stocks

    Okay, I am sorry to waste anybody's time if this information is right under my nose. I did some research and could not find a solid answer to sit with. My hubbies employer has set up company funded retirement stocks that we do not contribute into. The current market value is approx. $20,000. What is the status of these funds re: a ch. 13? Are they excempt or will we be required to cash them in and turn the $ over to a trustee? Thank you for your help and again I so hope this was not something I could have easily found myself. :

    I'm confused. If your husband is not contributing into the retirement stocks, how do you have $20K worth?

    If the stocks meet the definition of a retirement fund, then they will be exempt. It depends on how the retirement fund stock plan is defined for tax purposes. Your husband's Human Resources or Benefits dept can help sort this out for you. Your Ch 13 lawyer (if you've retained one already) can likely answer your question as well.
