I have been reading all the posts about income tax., I am getting back1,800.00 dollars., I read the confirmation order it says nothing about keeping or surrendering income tax., but it says all assets and income changes need to be disclosed. I am going to call my attorneys office today.

We got $1385 back and we get to keep it. We had to tell the trustee how much we were getting back but that's it. We're in VA so things could be different where you are. I'd still call your attorney.2/23/11 - Filed notice to convert from Chapter 13 (1/13/10) to Chapter 7

I just got 2250 back. I'm in the CLeveland area, Nothing in my paper work says anything about tax returns other than they should be filed. I know my payment went up a little before confirmation because they had to add my tax return back in for each month. My lawyer said I get to keep all of it and that is because it is figured in the plan.Filed September 15 2009

Just finished ours with $1700 federal and $110 state. Trustee gets anything over $1500. Have to send in copies of both returns and a check for $310. The $310 will go towards our plan payments, but it will not decrease the remaining time. The creditors just get that much more. For us getting a marginal return is the easiest way to save up for our property tax payment due in March.Filed July 2009. Discharged 08/08/2014. Awaiting closing. We made it !!!! Woo-hoo!

"Ok, our attorney told us we can keep 1600 of it and the rest has to go to the trustee. We filed Chapter 13 in October so we already had a lot of taxes taken out for the year. We've since then changed our filing status (on request of our attorney).
But for this year though, we'll be getting back more than 1600.
My question is....can you defer tax refunds to the following year knowing you'll have to pay (based on changing our withholding amounts)? And if so, can I defer just the amount that leaves us with a 1600 dollar return which we can keep.
Is that legal?"

However, only a tax attorney or your own bk attorney practicing in your state really can answer your question for certain.I am not a lawyer and this is not legal advice nor a statement of the law - only a lawyer can provide those.

Income tax in ohio
Okay I talked to our attorney today., He said I am allowed to keep 1500.00 of the IRS., he said I would receive a letter from the trustee if he wants to see my 2009 income tax return., and at that I would probably have to forward to him the additional $400.00 as I will be receiving 1,900.00....she said it will depend on him.
