    Additional Attorney fees....

    has anyone had to pay their attorney additional fees to amend something in their BK, where it was their attorney's fault for not having the correct info in the filing in the first place? I think it's rediculous. I have had to do it once already, and now I am afraid it will have to be done again before confirmation. Are these reasonable practices? Do I have any recourse?

    Our attorney didn't charge for amended schedules, and yes, the info was incorrect because someone in her office kept entering wrong data. I should point out though that on the contract for her services it listed what was included in the original fee, and the charges for extra services (also listed the extra services).

    Take a look at your contract with your attorney, you should get a good idea by reading it whether your attorney will charge you or not. Also point out that the info you gave your attorney was correct :-)

      The contract we signed with our attorney had additional fees for ANYTHING she did after confirmation. This is one of the reasons i began having second thoughts about filing in the first place.

        HC, I thought you had this worked out? Anyway, hit her with a feather bat and simply (and calmly) ask her for an explanation of what ever was missing. If you did not give clear explanation, then she is right. If her para-legal can't type, I would contest the charge. 'Hub

          I think i do have it worked out. I don't think the addtional fees will ever be an issue. just chiming in on the little info i had.

          I get to add so little. I just can't let an opportunity pass.

            The time to get the problem of any "extra fees" straightened out is before you retain the attorney. Read thoroughly any paperwork you sign to retain the attorney so you won't be in for any surprises later. Attorneys vary as to what is "additional." The only additional payment/fee we had to pay during our Chapter 13 was $400 for a Motion to buy out early via refinancing. That information (fees for filing motions, etc.) was indicated in the paperwork we signed when we retained our attorney.

              I would have never thought to ask about additional fees. I mean how would one know? I have emailed the paralegal and she has not yet returned my email. I will call tomorrow...
