    Joint Accounts?

    Hope I'm not using up my quota of questions..I have so many

    My wife and I share a Sam's Club account, which is also a charge card. We always pay the balance off every month - we usually just use it to buy cleaning products, cat litter, bubble envelopes (for my biz), and so on..my wife also uses it to put all of her gas in her car.

    Will I have to be removed from this account after I file 13? Obviously, this card is not being included in my case. Maybe just one more question for tonight

    If your wife and you share this Sam's account, you must include it in your case.

      Seriously? The account is actually titled in the professional office where she works - they have like a group plan or something, and their boss pays their dues and stuff. I'm on it as a user. I can see that being a huge problem for her!

      Why would I have to include it in my case if we owe no money on it? In fact, I haven't used the card in quite a while - like I said - she uses it for gas and general stuff for the house. Couldn't I just quietly go to Sam's and cancel my card? I could just get my own straight membership card (without the ability to charge on it). Is this like cut and dry, or would it be up to the discretion of the trustee?

        OK, now that I look at the statement..it actually comes only in MY name. Sweet Jesus..what a mess. I guess we can make sure it is paid up, then switch it over into her name, since it is her office anyway?

          The risk you take is that even if you don't list the cc (and you don't have to list it if the balance is zero when you file), the card may still be cancelled anyway. Credit card companies have a 'shared' database that lists who is deliquent and who files bankruptcy. Many major cc companies will automatically cancel any credit card that belongs to someone who files bankruptcy, even if the balance is zero.

          If you are filing alone, then your wife can consider opening a new card in her name alone.

            Last night, I called Sam's and canceled the credit portion of the card. They said there is a balance of like $400 on it, so I'm just going to pay it today, since I haven't even met with a lawyer yet, and it IS through my wife's work. Hopefully, it won't come up later, and honestly, all of the charges are hers anyway for gas mostly.
