    Results of my 341 today

    Well it was pretty uneventful although I felt my heart was coming out of my chest. The trustee asked 5-6 questions and raised our payment by $6 and said he would sign for a confirmation hearing and go on your way.

    My plan goes like this:

    Filed: 12/22/09
    341 : 02/2/10
    Payment: $272 (before today $266)
    5 years

    Well, just wanted to say thank you to all for the information and making this journey much easier......

    Have my first meeting with a lawyer on Friday. Credit cards are already calling, barely a month behind. Hope mine goes as easy!

    What kinds of questions did they ask? What reason did they give for the $6 increase? That's really nothing..I can't even imagine why they would go to the trouble. Guess I'm still really sort of unclear about how to calculate all of this. I did download the form 22c and sort of went over it. Is it basically your actual income, less all of the national and local standards, then any additional and debt payments that you include? So I guess any objections would be for those additional expenses? Just curious.

      I'm going to file bankruptcy, I haven't seen an attorney yet, but it's my only way out. I am reading up and down these forums to get a better understanding of things. Do you mind going into a little more detail with your story? How much debt were you in, was it mostly credit cards? I know this is different for everyone, but how much were your minimum payments before filing? Sorry for the bombardment of questions, I'm just trying to calm myself down because I'm a bit of a worry wort and I'm very pessimistic. I automatically see the glass half-empty, therefore I tend to think that even bankruptcy won't get me out of the mess I've gotten myself in.
      4/29/2011 - Filed Chapter 13, have to pay a massive payment each month!
      6/16/2011 - 341 meeting
      7/21/2011 - Confirmed!

        They just asked if anything had changed, am I at the same address, they basically confirmed what I had put down on paper and read out who put in a claim, etc. Someone else can chime in on calc, etc. I just truly believe I got on heck of an attorney and a trustee that's not out to get anyone.

          No problem, i understand completely. The veterans here on the board will be more detailed and informational than I could ever be. Here are my spec.
          75K Credit Card debt
          Surrendered Home
          Kept our car
          I was paying $800 a month on credit cards

              Unless your income is over the median income for your area, with very few exceptions, you should have no problem with a Chapter 7 bankruptcy. Be honest, disclose all debts, all bank accounts, all transfers within 90 days to unsecured creditors, all surrendered secured property, all transfers to insiders (family/friends/partners) within 1 yr, and answer the statement of financial affairs questions truthfully with related details, and you should go straight through. If you have any lawsuits for fraud, or you buy luxury items with your cards before filing you might have problems.

              You would reaffirm your car to keep it (assuming you don't have a loan with Ford Motor Credit who doesn't seem to want to ever re-affirm and would rather take the car back then accept your money if you file BK), get rid of your CC debt and other unsecured debt, and start fresh.
