    Owe taxes after filing.

    Hi there,

    We filed BK in Oct 09. Yet to be confirmed.

    We did our taxes and we will be owing about 7k. At the moment because of special circumstances we do not have the money to pay the new 7k in taxes.

    Is there a way to add post-taxes to the repayment plan, or do we have our lawyer file a petition to stop payment of the plan till we get these taxes paid?

      Since it is taxes, you have a few options.

      1. Simply modify your petition to include this debt on the theory that most of your tax liability existed before the date your filed. There are some technicalities in this option that hopefully your attorney can guide you.
      2. Amend your plan to reduce your chapter 13 plan payment by an amount that will allow you to pay the 2009 tax liability off in 36 months. (a guaranteed installment agreement under IRS terms). Essentially, you are adding an expense to your budget. For a tax debt under $10,000, the IRS allows a payment plan of up to 36 months with no questions asked.
      3. Dismiss and refile.

      Option 2 is the one most likely to work.

        I had my plan modified to add taxes I owed after filing.

        Discharged - 1/4/2010
