    Student loan issues...anyone heard of....

    I called Sallie Mae to get my 1098 info today and they couldn't tell me if my payments were being applied to my account or not...she said that the guarantor was handling the loan now....and they are NY Higher Education Corp.
    tried to call them and they are closed. I was curious if thye are actually applying my payments since some here on the boards have been thru some issues where the payments weren't being applied.

    guess I was just throwing this out there to see what you guys think?

    This is why I stopped paying on my loans because no one could tell me if any payments were applied or if they were just sitting in an account until after the Bk. I was told they were in deferment until after my bk was over.

      What if the Trustee finds out? is that an issue?

        We have government Parent Plus student loans and we do make payments on them when we can. Our payments are being applied to the loan balance every time they are received. We know this because we have requested in writing to receive a printed copy of all loan activity including every transaction every year since we've filed. So far, so good.

        Just from what I've seen posted here by multiple Ch 13 members with SLs over the last four years, it seems that government student loan owners are much more consistent about applying payments made to the balance during an active 13 than private lenders like Sallie Mae. More private lenders tend to hold payments in a separate account until you are discharged which allows the interest to continue to compound for three or five long years on the loans

          I am just torn about making the payments...but I am going to continue until our plan is confirmed because if the Trustee doesn't let us keep the SL outside the bk then it won't matter, but our lawyer said pay them so I am paying them...

          but then if doesn't matter since they don't apply the payments...then why make them???? I could use that $200 a month....
