    Home Modification Prior to 13 Question

    Hello!

    Our chpt 13 was dismissed last month w.o prej due to job loss back in August, even though new job was found fell behind on payments... So we are able to refile Here is my dilemma...

    We are to see the lawyer this Saturday to discuss the refile as well as pay the fees to refile(1400.00)... reason why we are refiling (still owe back property taxes, and 2nd seller finance loan)

    in the meantime waiting to have the money to refile, our mortgage company approved us for the home modification program @ a 2.18% interest it was 8.7% and our previous payments were 906$ a month (w/o escrow) so really our payments were about 1300$ a month with tax and ins. - they are offering the modification $ 805.04 with escrow and ins included this time... but we still need to refile so that we can repay the back taxes and 2nd seller loan...

    My Question is this

    Will chpt 13 effect this agreement? I imagine we could ask the lender but I really am not wanting to tip them off with advance warning that we are doing a refile if any of this makes sense?

    Remodification

    Your attorney may require you list your mortgage company in your "new" 13.... This will not affect your "modification" however it will "increase" the amount of your "monthly" payments. As long as you remain current on your mortgage payments you should be fine!!! Some lawyers will allow you to leave the mortgage payments outside of the plan (to be paid separately).

    Just a note: I hope you NEVER lose this AWESOME interest rate of 2.8%....

          You need to make sure your loan modification is signed, sealed, and final before you file. If it is pending or you are in a trial payment period it will be cancelled when you file for bankruptcy.
