    Months left changes, wife possibly pregnant.

    Hello,

    I am new here but have been reading for a bit. I have a few questions.

    1. My lawyer said that when we filed it would be a 3 year deal @ 1700 per month. We started paying on April 08, we got our recent yearly statement from the trustee and it is saying that we have 23 months left. There are no new debts.

    The lawyer is saying that he did not say 3 years but 3-5, how is this typically done?

    2. What happens if my wife becomes pregnant? We had a scare, we definitely don't want kids right now and use birth control, but if it were to happen what are our options?

    3. An add on to #1. After our first yearly statement it said we had 32 months left. After 12 more months of payment it says we have 22? How accurate are these numbers? Obviously it went down 10 months after 12 months of payments. I cant imagine this is normal?

    The obvious question is, how many payments does it say on the plan that you filed with the court? That is how many you will pay.

    Your district may also not start counting payments until you are confirmed.

    If you have a child you can modify your budget to account for the increase in family size.

      His basis for the 3-5 years is done by analyzing the debts you have to pay, remember, when your plan is filed, its just a plan, things can change, amounts, debts, etc. So to pay your specific plan in full, it required more than the minimum amount of 36 months.

      If your wife became pregnant, and your expenses increased or your income decreased, you would want to notify your attorney immediately, if you need to file a motion to modify your plan, it would possibly increase the months to pay off, not to exceed 60 months.
