    Started out 13 now it's a 7.

    Here is my situation, my husband and I filed chapter 13 last Sept we had our first confirmation in October. Well that was joke, because the lawyer screwed things up and we had to reschedule the confirmation until this month (jan). Well to make a long story short. My husband lost his job in the midst of this all and now the lawyer says we qualify for the Chapter 7. I thought there was a income cut off that one has to meet in order to file chapter 7. Our salaries were way over that median for our state. What the lawyer told us that the income that my husband made was our disposable funds and now its gone due to loss of job. Is he correct? Just too upset over the over loss of job and having to file bk.

    Count your blessings! Even though it's a bad thing that your hubs lost his job, it is a good thing as far as the BK is concerned because now you can get rid of your debt without having to go through payments for 3 to 5 years!

    Right after your ch7 is discharged hopefully your hubs will be able to get another job and you'll be good.
