Had a claim on our original claims list of furniture totaling $1,195 being made outside of the plan. Had been sending monthly payments to the original lender since filing with no problems. Requested a reciept of payments to date and got a letter back stating that they wrote off our account and sold it to B Line collection agency and they are now responsible for collecting the outstanding balance. As a result of the sale, they no longer have any information on our account. It is now a new claim listed on our claims list as unsecurred debt showing the original balance of $1,195 at the time of filing. We have made $500 in payments and have no reciept except for the canceled checks. Will this now be paid under our plan or are we still responsible for the payments and outstanding balance? There is no address or phone number in the letter to contact the collection agency. Our records show we still owe a balance of $695. This was a same as cash purchase that waived interest payments if paid off in 24 months. Our last payment would have been in August 2010.

If this is a new claim, then you need to work with your attorney to Object to the Claim. Especially if it was filed post confirmation and after any "claims bar date".Chapter 7 (No Asset/Non-Consumer) Filed (Pro Se) 7/08 (converted from Chapter 13 - 2/10)
