I will be qualifying for chapter 7 after our child is born. I am currently in chapter 13 for the last 3 months. My question is can i use another lawyer to convert to 7. I dont feel the lawyer we have is honest with us. He wants to charge me $900 to convert. Just curious if anyone else has done this. Do I need permission from the trustee also?

No, you do not need your trustee's permission to get a new attorney. However, you should think this over carefully. Most bk lawyers do not like taking on already-filed cases and may charge you more for doing so. That $900 could end up looking like a bargain. So proceed very carefully.I am not a lawyer and this is not legal advice nor a statement of the law - only a lawyer can provide those.

I agree. Only $900 to convert is very cheap. Many attorneys would charge you the full price for a Chapter 7 which averages about $1,500. Plus, your attorney knows your case.
With whatever decision you make, we are behind you!Chapter 7 (No Asset/Non-Consumer) Filed (Pro Se) 7/08 (converted from Chapter 13 - 2/10)
Status: (Auto) Discharged and Closed! 5/10
