Should I Start Doing The Happy Dance.

I'll like to first of all thank this website and all the folks who post on here, I've been coming on here for the past 2 years to read all the posts and learn more about BK. I've worked so hard on my credit report and rebuilding credit just from reading threads that my middle score is now 699.

I've been in chapter 13 since 10/06, last year my wife and I decided to pay off the bk so Dec 12 we paid off the remaining balance $5200 and today I just checked the National data center website and on there is says my case status is COMPLETED [ PAY ALL CLAIMS & PAY BALANCE TO DEBTOR]

I'm happy for that, but should I start doing the happy dance or will it take another 3 months to get the discharge paper from the court before we start shopping for a mortgage loan

Congratulations! It must feel great to see those words on your trustee's website!

...will it take another 3 months to get the discharge paper from the court before we start shopping for a mortgage loan
First, the amount of time it may take for your trustee to do the required audit can vary from 2-6 months, depending on how overwhelmed your Ch 13 trustee is with cases.

Also the chances of getting a decent mortgage loan right out of Ch 13 are small, especially in today's poor economic climate. You may have to wait a bit and build up your credit score a bit more.

Be sure to find an experienced mortgage broker who has helped discharged Ch 13 filers before - that can make a big difference. Your lawyer may have names for you to contact. But keep in mind that you need to have that all-important court discharge paper in your hands before most lenders will even be willing to talk, especially since your discharge is coming earlier than originally set.

Hope everything works out for you. Let us know when you get your discharge so we can have your official discharge party!
I am not a lawyer and this is not legal advice nor a statement of the law - only a lawyer can provide those.

          06/01/06 - Filed Ch 13
          06/28/06 - 341 Meeting
          07/18/06 - Confirmation Hearing - not confirmed, 3 objections
10/05/06 - Hearing to resolve 2 trustee objections
01/24/07 - Judge dismisses mortgage company objection
          09/27/07 - Confirmed at last!
06/10/11 - Trustee confirms all payments made
          08/10/11 - DISCHARGED !

          10/02/11 - CASE CLOSED
Countdown: 60 months paid, 0 months to go

I just got my Chapter 13 Trustee's Notice Of Completed Plan Payments in the mail this morning with a check for $203. Talked to a couple of lenders that have worked with folks with a cheaper 13 my attorney referred me to. With my above average score, the credit line I had build up in the past 2 years with my secured card and my 11 years employment work history they say it won't be a problem getting an FHA loan.

** Now I'm really doing the happy dance***
