    Chapter 13 Schedule J Questions

    Ok heres my situation my fiance is about 16 months into a planned 3 year chapter13. I live in her house so my income and expenses our included but I did not file. Lawyer sent letter letting us know that one of my loans was paid off and we should review Schedule J and set up an appointment because the trustee here in cincinnati will want to increase payment. So here our some things below that have changed.


    Water Bill 35.00 now 41.00
    Laundry and Dry Cleaning was 0 now 25.00
    Medical and Dental 45.00 to 65.00
    Directv was 76.00 to 91.00
    pets was 20.00 now 35.00
    Cigaretts was 40 now 55.00
    My Prescriptions was 55.00 now 125.00
    House insurance was 50.00 now 65.00

    Also I have no idea how this was left out originally but My fiance and I both live in a suburb of cincinnati that is considered a town by itself so on top of the local Tax that gets taken out of our payroll checks we owe the town of North College Hill each Year. 62.00 a month for her and 40.00 a month for me.Will this be allowed to be added?

    When I talked to lawyer to set up appointment he seemed aggravated and said that its going to mess up our step up plan and payback percentage. We certainly cant be the only ones in chapter 13 with expense increases. I have the appointment set but my mind is racing. Barely getting buy now don't know what will due if payment goes up. Thanks for any help

    Sure the lawyer is going to be upset. It's a whole bunch of extra work which (hopefully) isn't going to generate any revenue for anybody, either the trustee (meaning unsecured creditors) or the attorney.
    filed chapter 13..confirmed...converted to chapter 7...DISCHARGED!

      Sounds like your Ch 13 trustee may be one that gets antsy if the payback % falls below a certain level.

      Bottom line - the lawyer is representing your fiance (and indirectly you as well), not the trustee. Whatever your combined figures are, that's what they are. (I assume you can prove each of them if asked.) All income *and* expense changes should be reflected in the amended plan.

      07/18/06 - Confirmation Hearing - not confirmed, 3 objections
      10/05/06 - Hearing to resolve 2 trustee objections
      01/24/07 - Judge dismisses mortgage company objection
      09/27/07 - Confirmed at last!
      06/10/11 - Trustee confirms all payments made
      08/10/11 - DISCHARGED !

      10/02/11 - CASE CLOSED
      Countdown: 60 months paid, 0 months to go
