    Creditor calling...

    ... THIS MORNING. Gee do you think they wanted to wish me a Merry Christmas? My voice mail is deliberately "full" and I refuse to empty it. Been that way for months and months. And I was still in bed and didn't get up to answer the phone. It was just on my caller ID. I don't want to get hostile with them, because it is not this creditor's fault I filed Chapter 13...but I KNOW they got notice of my BK. Anybody got a clue by 4?

    Answer the phone and tell them that you filed. Write down the date/time and person you spoke to into some sort of log/ledger to keep track. The phone should stop ringing.

      I would have, but I never answer the phone before coffee. And I was still in bed and the phone was in the other room.

        Or, do what I did. I went through my voicemail... wrote down all the names and numbers and entered them into my log (spreadsheet). Then I sat down and called EVERY SINGLE one of them. It was fun because first, I called them. They were nasty too, asking me why I was calling and junk. It was nice "threatening" them instead of the other way around.

        You need to be short with them. Tell them that you filed for Bankruptcy protection and that you want to provide them with your case number and filing date. Don't let them bully you, because they will. They'll tell you that "until they get a letter"... they can keep bothering you. I just tell them this...

        Under 11 USC 362 you are stayed from continuing collection activity on this account. This phone call is constructive notice and you should write down the information concerning the case number, date and venue. If you don't understand how to deal with a bankruptcy, put someone else on the phone who does. If I were you, I would be careful what the next thing I say is.

          Oh that is cool. But I expect something way cool coming from you! I haven't been bombarded with calls, really. Just two. Most of my debts, except for the medical bills are pretty old (2005 divorce leftovers) and I guess they gave up already.
