I have: mortgage payment, car payment, 401k payment. Are all of these must be included in payment plan or can I pay mortgage and 401k ( currently auto-withdrawn) outside tha plan. I am in Oregon. Anybody with experience?
Thanks.
If your 401(k) is automatically deducted from your paycheck, it should continue as such. Whether your secured debt (home, car, etc) is paid "in plan" (thru the Trustee) is a District-specific question. Many Districts, however, do require that all secured debt is paid through the Trustee (a/k/a "in plan"). From my cursory glance, Oregon may require secured debt to be paid "in plan". If you are current on your home and car payments, these can usually be paid "outside the plan" upon a request to the Court.
