Okay, Got to speak to a real person and she went over my means test with me. I now understand why at this time I have to go with a chapter 13. I have looked at everything I was charging the last few years and most of it was bills & food. If I remove my CC payments out of the picture ($2100 a month) then I should be able to cover everything with my income. I'm not doing the house because it has never been late, just my creditcards.
Now I have to change banks. Wife not to happy about that but I'm trying to fix the mess I made from being self employed so we can move on with our lives. My attorney is going to review the file this week and in two weeks or so it should be filed. I guess its about 5 or 6 weeks after that for my meeting? Then if nothing pops up it will confirm in 6 months? Not to sure how everything else will go. I gave my attorney a heads up that if my income is still crap in 6 months I want to review everything and try to switch to a chapter 7. It would be a lot less stress for me if I can start over sooner as I would like to move near family.
As I understand it... if you live in a community state and only one person files chapter 7 or 13 it will wipe out the other person that is linked to the debt? I have a reserve line on my bank account with my wife and I just want to make sure that they can't go after her if I do a 13 now or a 7 later. Anyone know more about that?
