    Just a couple of questions

    If you are into you chapter 13 for well over a year can a trustee raise your payments at anytime and can you purchase a car with a foreclosure on your credit record along with a chapter 13 on your record. Are you allowed to have a savings account............thanks

    1. Trustees cannot randomly raise your payment. And it is quite rare for trustees to do so. It will depend on how much over site the trustee is doing in your case. Most trustees only require you to submit a copy of your tax returns each year. If the trustee sees a "significant" increase in your income over what you stated on your original petition, they could file a motion to modify your plan. But most trustees don't tinker with a plan once it has been confirmed, they have better things to do.

    2. Car dealers are fairly liberal with their lender requirements, if you show a good payment history with the chapter 13 trustee, you can probably get financed, but you need to set proper expectations, you will probably need to buy from a "buy here, pay here" type dealership and you will probably have high teen, low twenty interest rates. Also, remember that you need to get permission from the BK trustee before buying the car.

    3. Yes, you can "have" a savings account.
