    Freaking out! Dumb A@@ that I am!

    We turned in all our paper work to our Attorney who we have met with several times and really like. He is going to input all the numbers and we are to meet with him again next week. Here is the deal... We have about $315,000.00 in unsecered debt. At least $175,000.00 is from a business (dental office) that we now longer have. My husband was sole owner no LLC or anything like that. Is there no way we can file under a chapter 13 with that much unsecered debt? We are in the state of Indiana. Thanks for your help.

    The debt limit for unsecured debt in chapter 13 is $336,900, so you should be fine assuming chapter 13 is the direction you need to go.

      Thanks for your reply. Not the way I want to go but we make to much to do a 7. Can't wait to see what my attorney says in our next meeting. I have learned so much from these boards.

        If you can prove over half your debt is business realted (non-consumer debt), you are exempt from the means test and may be able to file a Chapter 7.
        Make sure you get an attorney who is willing to run the numbers and find out.
