    Problems with student loans AFTER discharge???

    I will try to explain clearly, but bear with me.....

    filed 13 Dec. 04......current on both student loans (there are two loans but both were collected through AES)

    continued paying on both loans (one payment but applied to 2 different loans) after filing and confirmation

    3 months after filing the private loan(TERI loan) pulled their loan from EAS services, wouldn't allow AES to apply payment to loan, stated that their loan was put into default because of bk and that we would resume payments after discharge

    we continued to pay our montly payment to AES (although it was a little less than before because they deducted what was previously going to the TERI loan

    fastforward to now......we recieved our discharge papers last week.....yah, right?, not so much

    My husband was actually going to spend today trying to find out how to resume payments on the TERI loan, but I guess we got our answer anyway....

    I get a call from a collection agency today claiming that we are in default on our student loan, haven't made payments in over 4 years, and they have been given the job of collecting our debt. I am told that I can send them a 'good faith' payment of 10% and then pay 1% monthly.....

    Ok, I cried, yelled, and cried some more. After a billion phone calls we find out that TERI has filed bk and can't collect their own loans, thus giving all their accounts to these collection agencies. They USED to have a plan where if you made 5 on time payments your account was put back into good standing and then returned to AES to again become part of the orginal student loan repayment process....but since they filed bk that program no longer exists. It seems we are stuck dealing with a f'n collection agency with no fault of our own. We didn't even have to deal with collection agencies before filing, as we were current on everything up until filing. I thought discharge was going to be a fresh start?????? So much for that. I'm sick to my stomach.

    My husband is going to meet with the lawyer tomorrow afternoon to look everything over but I doubt there's much we can do. We did everything we were supposed to and still got thrown to the sharks.

    Life really sucks right now.
