    Pacer document question

    I have listed in my creditor filing pages a motorcycle that I originally listed as being surrendered. I looked up my case on Pacer today because it is the last day to file claims. I see there is a claim on the motorcycle I am surrendering with a secured and unsecured amount. It is listed as follows:

    HSBC Bank Nevada, N.A. date filed 11/16/2009

    Unsecured claim - $3084.98

    Secured calim - $5510.00

    Total claim - $8594.98

    The unsecured amount is approximately the amount of payments I have made.
    Why is there even a claim on this when I agreed to surrender the vehicle?
    I also agreed to surrender a boat, but there is no claim on it.
    Input please...thanx.

    Do you still have the motorcycle in your possession? Is it still licensed and insured? Are you still using it? Are you still making payments on it?

    Some lenders are more prickly than others. Ask your lawyer to ask this lender what precipitated the claim since you intend to surrender. It may be that you will have to actually surrender the motorcycle to the lender - have them pick it up - to get them to withdraw the claim.

      Do you still have the motorcycle in your possession? Is it still licensed and insured? Are you still using it? Are you still making payments on it?

      Yes I still have it in my possession.
      Yes it is still insured and registered.
      Yes I am still using it.
      No I am no longer making payments.

      I wanted to keep the bike because it is great cheap transportation for work. It gets 55mpg and the insurance is cheap. Lawyer suggested I surrender to show compassion to unsecured cc's. It is financed through a HSBC for Pete's sake! I have gotten no notice of repossession or even a letter of what I should do with it. Still waiting!
