    How critical is confirmation attendance?

    Confirmation is coming up on December 1 and I have a dilema. Wife is an operations manager for a growing health care company and is scheduled out of town on a weeks worth of flu clinics the week of our confirmation. She is managing these clinics and is mandatory she attend (she just got the job order today). I will be on temporary layoff at this time (from Nov. 25 thru Dec. 31) and have the opportunity to accompany her as a clerk for the clinics. This would suppliment money that I will be loosing on layoff. Can our lawyer represent us at the hearing? Can we reschedule? The confirmation has been rescheduled once already by the court. Our 341 went without hitch and all creditors have filed claim that are listed in our bk. Our claims deadline is Nov. 16 and so far no objections or complications. Input please. Thanx.

    I don't know about your district, in ours we would only have been required to attend if the trustee was objecting to confirmation. Ours was on the consent calendar so we didn't need to be there. Your lawyer should tell you whether or not you need to be there.

      Call your lawyer and ask whether or not you need to be there. The answer is probably no.

        Also, is your attoroney aware of your temporary layoff and supplemental income during that time? You'd better bring that and the amounts involved to his/her attention.

          Contacted attorney last month with news of layoff and he said it was not long enough to change anything in my case. I get payroll deductions and will miss a months payment, but will continue starting Januray. He didn't seem too concerned. The "supplemental" income for the week I will work with wife is only 1/2 of my regular job pay. I will make about $300. I get a 1099 at the end of the year for it. I don't think that will change my monthly payment considering I have a week waiting period before I can receive unemployment benefits. At least I will have some income during the first week of layoff.

            My lawyer told me to call his office the day before my confirmation to see if I needed to attend. Thankfully I did not have to attend. Maybe your lawyer can find out sooner than the day before for you.
