My sister and I had to file chapter 13 about the same time. Her confirmed plans states that she has to have income review every 6 months and send copies of her tax return. My confirmed plan states nothing about either of those issues - it does not mention tax returns nor was it ever mentioned during our hearings. So, do we have to send one in? I wasn't sure if different trustess require them or not (seems like lots of people on here have to send them in) My sister and I have the same trustee.

My opinion would be if they dont ask for it "don't give it to them". Even though you have the same trustee every case is different and has different circumstances...

My lawyer (not the bk one but a good friend) told me never to give anything more than asked. If in a depo, "Yes, No, or I don't recall". He states to always tell the truth but volunteer nothing.

Thanks for the advise. That was what I was kind of thinking as well. I don't know if the difference is b/c mine is a 100% payback and her's isn't? Anyway, I think I'll just be thankful for what I don't have to do and just keep going forward!Filed 1/09 Confirmed 6/09

The answer to this is easy.....ask your lawyer whether you have to provide annual tax returns to your trustee or not. You don't want to find out that you should have sent in your tax returns when you get your trustee's Ch 13 dismissal order in the mail (or see it on PACER). Ignorance in this situation is not a defense.
This is the time to be proactive - call or email your lawyer and find out for sure. It's hard to believe that given you and your sister both have the same trustee, your sister has to send her returns in and you don't.I am not a lawyer and this is not legal advice nor a statement of the law - only a lawyer can provide those.
