    Southern District Court (Columbus OHIO) Experience

    Hi Everyone -

    Due to debt incurred fighting for child custody and other attorney costs I am forced into CH 13.

    How has everyones experience been with the Trustee in the Southern District Ohio Court?

    I have found the So-OH trustee to be very good, I read horror stories on here and am so glad that my trustee isn't anything like that! He allowed me to include my student loan payment in my expenses, we had some over IRS standards medical expenses that are on-going, he was ok with that as long as we proved them, doesn't check up on us yearly for tax returns, allows us to keep some of our tax refunds (amounts under $1600 I think, although we adjusted our deductions anyhow so haven't been getting big returns). We had a big change in income, and he allowed us to do a 3-month forebearance of payments and then approved a change in payments due to income staying lower. Approved us to get a new vehicle mid-stream (we had to file a motion to incur new debt), we did that at the same time as the change in income, so included the vehicle payment into the new trustee payment, so really, been very good as far as ur personal experience has been. Truth is, we probably do a CH 7 now because we now pass the means test, so I guess he's happy we pay $400/month. Sometimes I wonder why I stick with the CH 13, to tell the truth, but since the CH 7 isn't a guaranteed slam-dunk, don't want to dismiss my 13 (I'd have to do that rather than convert because despite passing means test, we really do have some disposable income so would need to incur a few new expenses like a 2nd car payment to make a CH 7 work) and I'm not willing to risk it not working out for the 7 and having to start the 13 all over again I guess.

    Plan Modified July 8, 2009 from $1100/month to $400/month due to change in income, finally discharged in July of 2013!

        We have had a great experience, not like some of the micro-managed cases I've seen here on the forum. We just finished up our payments a couple of weeks ago and area awaiting our dishcarge papers.....

        I think the key is also to have a good lawyer, we saw some people at our confirmation hearing that had horrible representation. For us the combination of a great attorney and a very reasonable and sensible trustee made what could have been a tortuous 5 years much easier than anticipated.
