    Is is normal for your primary mortgage not to make a "claim"?

    I just looked at 13datacenter.com and noticed that our 2nd has filed for a claim but our first has not. Is this normal?

    My first never filed a claim but my 2nd did. Both are paid outside the plan and both show up on my credit as being in ch 13 bk.

      Hmmm, I never thought about it. Both of my mortgages are paid outside of the plan and neither has put in claim (yet). They have until 30 Nov for me.

      But then again, they are secured by my house so they are getting their money anyway.
      CH13 - filed 30 JUL 09, $1521 @ 60 mos (100% payback)

        Does it make a difference that we are walking away from the house? They know that too. We could sell it and get all but aobut 25% of the 2nd, paying all of the 1st but were advised against doing a short sale and just do a foreclosure by our attorney since we have the 13 on our credit anyway.

          My 1st mortgage was the first to make a claim even tho we are paying outside the Bk
