    Payment a week late..

    Found out my payment will be increasing, what's the consequences of sending the payment in a week late?

    A chapter 13 payment? A house payment?
    Pay no attention to anything I post. I graduated last in my class from a fly-by-night law school that no longer exists; I never studied or went to class; and I only post on internet forums when I'm too drunk to crawl away from the computer.

        Have you informed your attorney that you will be late? The trustee could motion to have your case dismissed. Hopefully you will be able to make up the late payment before a motion to dismiss is filed.

          Most trustee's offices don't get too bent out of shape until you are 15 to 30 days late. You don't even need to bother your lawyer, just get your case number and call your case worker at your trustee's office and tell them.

            Payment was $330 raised to $475, was ready to send in the $330 but was informed that it was raised to $475. Won't have the balance until next Wed, and then sending it right out.

              My trustee has a written policy that once you are behind 2x your payment amount they file to dismiss your case and no action is taken prior to then.

              May want to ask your attorney how your local trustee handles late payments.

                Our attorney advised us that for whatever reason if we could not make any Plan payment on time, to contact him immediately. Most trustees, when you are representated by an attorney, will not deal directly with you and their office will advise you to contact your attorney since you are represented by counsel.

                      But even still, I thought payments were based on your disposable income? Just because another creditor was added shouldn't mean your payments go up, it should mean that they just less of whatever you pay in.

                        Well Attorney reworked the numbers and worked out to this new amount.
                        At first he said I would be like starting the plan all over & I would have to repay his fee.
