    chapter 13 help

    i am considering chapter 13. have been viewing this site for days. my creditor payback is 50% after exemptions. i am afraid that there will be months i wont be ble to pay. also what happens at the creditors meeting. what is required of that and what do i need to bring.

    Unless you have something unusual in your case that catches the trustee's eyes, you get asked about 10 routine questions about your finances and your bankruptcy schedules. Usually, you need to bring your lawyer, of course, and your social security card and some form of govt. issued ID.

      just wondering if i am better off trying to negotiate with my creditors on my own. i know that banks have been settling for 20-30% before charging off. my disposable income seems quite high on bankruptcy side but when i add up my monthly expenses it seems as if i will barely have enough for groceries & gas. the majority of my paycheck is comission and with the economy i am afraid there will be a time when i cant make that $1300.00 payment

        Are you trying to do this pro se?

        You'll find a lot of knowledgeable people here who might be able to help. But you'll need to give some details. For starters:

        How did you come up with a $1300 payment?

        What is your income? Your spouse's income?

        How many in your household?

        Do you own any real property?

        Who do you owe? How much? Is it secured or unsecured?

          attorney came up with $1300.00. my income last year was 100k. this year less than 70k. my spouse makes about 85k. there are 4 people in my family. the house and home equity are not in my name. everything else is . secured is about 30k unsecured is about 80k. i also owe on 401k loan. my husbands credit is perfect. if i wasnt paying 640month on 401k loan for another year i think i could swing it. this is not something that i want to do but my job is based on the economy and i never thought i would end up here. its bad enough that i havent been sleeping at night worrying bout juggling bills now i have to worry that if my comission check is going to be enough to pay the trustee
