What will trustee do with a leased auto?

My auto is lease and up in November 2010, tried to trade in early no luck., now when this is up in November 2010, will the trustee permit to include a car payment? Right now I am looking at my parents purchasing a car for me then but I make the payment, will the trustee permit that?

every district and trustee is sooo different that it is hard to say. Your attorney would know of course, if you can get ahold of him.

In my opinion, unless you have title to the car, the cost and expense of the car would not be included in your plan. Your best best for now might be to hang on to the car and have the cost and expense of it included and then when the lease is up, have your parents purchase a vehicle.

We had a lease that was up 6 mos. into our 13. The payment 450 was allowed as an expense and when the lease was up we were able to get approval to buy new thru trustee and court, as long as payment stayed close to the same or lower.

How did you buy new while being in a chapter 13?

              Thanks Maddog

Sorry for having you repeat yourself, I am just going in circles., but anyway I tried to purchase a new car but the dealership would not even except a cosigner as they tried several banks, and the banks they said are not stupid they can see by my non payment of cc that I will be filing bankruptcy., that is what they told me..........so , I guess just wait till my lease is up and pray I can get a reliable car.
              Thanks

Hey whirlwind, no problem I owe alot to this forum for all the help I`ve received. Plan on doing some planning on purchasing in a 13. It was hard to find someone who would finance even though I had a large down payment. I was told if I had been in my 13 at least a year, I could have gotten a 13% loan. I couldn`t wait cause my lease had to be turned in and we needed a vehicle for work. The good thing was, even though we were over on our miles by 10k, I think fifth third was so happy to get their vehicle back, they never even questioned it. Good luck. we`ll be here to help. We used drive auto, and even though I had heard some horror stories, I haven`t had a problem in 2.5 years.
