    Buying a car before BK, need a cosigner?

    Hi all,
    I lease my car, the lease will be up November 2010., I called the dealer today and asked about me buying the car early, he advised not to buy the vehicle I lease, but another, I explained to him about the Chapter 13 I am going to file., and he advised what we should do is, turn in her lease early., then purchase not lease but purchase(similar to what others have said on this board), a new vehicle., he pulled my credit score and it already went way down., so he advised I will need a cosigner in order to obtain and puchase a vehicle., so my mom offered., she works part time.., but knew up till this situation I have always paid my bills on time., so the sales man is going to run everything thru the account manager., but he feels it should be fine if need be my dad's retirement could be added in as a cosigner also. But he feels just my mom cosigning is enough., My payment will be about $450.00, I had to do something as when my lease comes up I will be in Bankruptcy and I am sure even with a cosigner they wouldn't give me a loan. So hopefully this is all taken care of this week. Any suggestions., or advice please ....also., I am not including anything whatsoever with my auto in my bankruptcy. Other question, I will probably have the loan for 5 years so then my bankruptcy would be discharged, what happens in the meantime if my car would be in an accident and be considered totaled., I guess I would not be able to obtain another vehicle., then I would be in a fix., boy this is so difficult., I certainly wish I didn't have to file bankruptcy, but I have no choice.

    First, why obligate your Mom? In this economy nothing is for sure. You are still leasing so there is no emergency. The car guy is trying to turn a sale that is all. His advice is flawed. You have time to save and get a good used car for cash. Stop paying the lease and I'll bet you can save that money four months and get a car. 'Hub

      well you have to do what you have to do and you need to be sure your vehicle will make it for the 5 years. I could have spent every night of my life losing sleep over the "what if's" For now, just deal with "what is" and forget the rest.

        Question regarding cosigner?

        Does it make any difference to the trustee that my car is cosigned., I am still the one responsible to make the payments and will do so. I just didn't want this to hurt anything before I filed. I wanted to make sure the car payment can be deducted from expenses?

          no it won't change anything. The co debtor will have the co debtor stay in place just like you have the stay in place. However you must list the cosigner in your petition.
