    Means test vs. Schedule J

I just received my proposed plan (another one), the lawyer is proposing a monthly payment of $2260 when the Scheduler J shows a payment of 1185. There is no way that we can survive with the $2260 payment. Any advise would be greatly appreciated.

Why is I/J and means test so much different? Loss of income?
Pay no attention to anything I post. I graduated last in my class from a fly-by-night law school that no longer exists; I never studied or went to class; and I only post on internet forums when I'm too drunk to crawl away from the computer.

      MSbklawyer,

No loss of income, even when I do the means test, I come closer to the $1185 a month. I have ask questions on the numbers they are using but I get no answers from any of them. When I compare the numbers they used with the numbers I used, there is no a lot of differences, I don't know what is going on

So when you asked your lawyer to explain the differences between what you believe the figures should be and his, he sat there silently?

Go back and try again. This time don't leave until you get satisfactory answers that you understand.

You should NEVER sign Ch 13 bk forms that propose a payment that you know will be impossible to make for five years. You need to resolve this before you can file, and no one else can do this for you. You have to step up and get the answers you deserve.
I am not a lawyer and this is not legal advice nor a statement of the law - only a lawyer can provide those.

        06/01/06 - Filed Ch 13
        06/28/06 - 341 Meeting
        07/18/06 - Confirmation Hearing - not confirmed, 3 objections
10/05/06 - Hearing to resolve 2 trustee objections
01/24/07 - Judge dismisses mortgage company objection
        09/27/07 - Confirmed at last!
06/10/11 - Trustee confirms all payments made
        08/10/11 - DISCHARGED !

        10/02/11 - CASE CLOSED
Countdown: 60 months paid, 0 months to go
