    New State New Apartment

    Okay, so I'm really stressing right now about what I should do. I am currently living in Illinois right now and I'm relocating to Georgia first week of November. I was going to file BK here in Illinois but now I'm concerned about making it back for the court date and being able to rent an apartment in Georgia.

    Has anybody had any problems renting an apartment after filing Chapter 13 BK?
    Also I spoke with a Georgia BK attorney and he said I would have to wait 91 days before I can file in Georgia. In the mean time I have creditors giving me time limits or they are going to sue me. I can't wait 91 days and I don't want a garnishment papers hitting me new job.

    The only thing stopping me from filing here in Illinois is having trouble renting in Georgia when they see the new chapter 13.

    How long does it take for the chapter 13 to show up on my credit report?

    First, if a potential landlord asks about bankruptcy or there's something on the rental application that asks if you have filed bankruptcy, then share the information honestly. Otherwise, you aren't required to mention it.

    From the experiences of our filers here, very few have been turned down by landlords because they filed bankruptcy. Getting out of the big apartment complexes and finding smaller units or homes increases the chances of finding a landlord that understands that sometimes life gets in the way and you are doing your best to fix your financial situation.

    Some filers with hesitant potential landlords have offered to 'sweeten' the deal by paying down two months for a deposit. Also it helps to point out to those landlords that by filing a Ch 13, you are paying back your creditors much of what you owe.

    How long does it take for the chapter 13 to show up on my credit report?
    It will show up quickly (within 30 days for sure, probably sooner) after your Ch 13 is filed.

    07/18/06 - Confirmation Hearing - not confirmed, 3 objections

    01/24/07 - Judge dismisses mortgage company objection
    09/27/07 - Confirmed at last!
    06/10/11 - Trustee confirms all payments made
    08/10/11 - DISCHARGED !

    10/02/11 - CASE CLOSED
    Countdown: 60 months paid, 0 months to go

      Well I called the apartment complex today that I want to move into just to ask what the requirements are. She said they look at employment history, apartment history and criminal background. I have good employment history, great apartment rental history and no criminal background. She said the only thing that will get me turned down is a Bankruptcy within 2 years. So my chapter 7 was more than two years ago, but if I file this 13 that will get me turned down.

      I didn't mention to her, that I'm looking to file chapter 13. She did tell me that since I'm not there yet, I could complete the apartment application and holding deposit through the mail. If I do that and decide to file in Illinois before I go, the apartment won't see the new BK. *SIGH* such decisions.
