    Student Loan Question

    My wife and i stoped paying our CC's in Aug. We are planning to file in Jan or Feb, but i have continued to pay my wifes student loans. Should i stop paying these also? For some reason i assumed since they weren't dischargable that I should keep them current.

    Is that silly?

    by all means pay those student loans. In fact throw as much extra on them as you can afford before you file. They will be suspended during your plan and the interest will accrue anyway. (not sure if that means they are preferential but I definitely wouldn't let them get behind)

      This is what i thought. I am staying current on everything that won't be included in the BK (home, cars, current taxes) and things that i have been told are not dis-chargable (student loans and some unpaid federal taxes).

        I am paying on my student loans outside of my ch13 plan. I am techinically in a "default" status on them because of filing my ch13. However, according to my plan, I must continue to pay them each month because it was an allowed expense.
        Therefore, the interest isn't accruing during my ch13 and I'll owe substantially lower on them when my ch13 is finished.

        I too was current on my student loan before filing. It's smart to continue to keep them that way....

          See my highlight in red above...all debts must be listed when filing and even if your car and home are not "included" and you continue paying on them outside a Chapter 13 or after filing Chapter 7, they are still considered as being included in and part of your bankruptcy and will show as such on your credit reports.

            be sure you guys check out www.ibrinfo.org about the legislation in student loans, a step in the right direction...but not a lot of relief.
