    341... trustee unhappy with car payments

    At the 341 the trustee said our car payments were way outside of what our district accepts. He told our lawyer he needed some more time to look over the case before deciding what to do.

    Has anyone else had this happen? What are the things that could happen now?

    Just curious, how much are your payments? Your lawyer should have seen that coming and prepared you for the situation.

      $525 & $460. The lawyer did mention they were a little high, but that was it.

        $489 is the IRS limit. So the $525 might be what is in question. But it's not that much over. You could offer to maybe bump the payment up by $36 maybe. It may have to do with the amount/% payback you are proposing. If its a low %, they may just be wanting to squeeze some more out of you in any area they can find.

          Our car payment is $661.00 a month and the trustee never mentioned anything. Our lawyer advised we not reaffirm as of today we only owe $4000.00 yet to pay and the judge would have looked over our expenses with a fine tooth comb and she didn't think it was worth the risk of having the courts "eyeball" us that closely.

            My district doesn't seem to care about IRS limits.... When I created my budget I used number a few dollars below IRS limits for expenses and was told they would never fly in our district, most of the amounts were lowered.

            I am only paying back about 18% to unsecureds. $1000/mo - 60 mos.
