    Question about claim

    I'll try to be brief...we're 10 months into ch13. One debt was a $1500. loan taken against a mimimal life insurance policy( they didn't file a claim). Yesterday I received a bill for the yearly premium and it also included the interest on the loan. The premium is only $57., the interest is $176.

    Shouldn't the loan be wiped out? Are they just trying to see if I'll pay it? Can I pay the premium or should I ignore the whole thing? My lawyer is very difficult to get hold of,,,thus the ?? to you guys.

    If you included the debt in your bk filing and the creditor did not file a claim, well, then they dont get a piece of your payments. You can ask your bk attorney to send them a letter stating they cannot collect on this debt due to the automatic stay from your filing and also point out that they did not file a claim with the court before the deadline, if this is the case. OR, you can do this and send them redacted copies of your court papers and your case number.

      by not paying this does it cancel out your insurance? If so you might want to get some term life insurance and let this one cancel out
