    Odd Claim

    I noticed a creditor "Bottom Feeder Debt Collector" submitted a claim that was not on the matrix. They claim it was from a Finger Hut purchase back in 1997 which I have NO Recollection of ever using Finger Hut.

    I have asked my Atty to object based on statute of limitations. The claim is for $239.00. 30% of $239.00 amounts to $71.00! What a waste of their time!

    OMG! Finger Hut! I totally forgot about their existence. Thanks for giving me a chuckle this morning.

      It happened to me too. I think it was Jefferson Capital that filed the claim on behalf of Fingerhut.

        Since it is a 1997 debt (which I have no recollection of ever ordering from finger hut) I wonder if they will object to the objection. I know they didn't check my credit report so one of the bureaus must be report the data to bottom feeders.

          For the amount of the claim, it may cost you more to have your attorney object. Are the objections part of the retainer? I would not use the SOL to object, though. The court did not notify this creditor, correct? How did they come out of the blue and file a claim? Something smells fishy. The thought has always crossed my mind that there are predatory creditors out there willing to risk filing a false claim to make a fast dollar. Are there any supporting docs submitted with this claim, like a historical bill? Each claim form submitted is under penalty of perjury. Maybe this creditor doesn't think you will notice since the amount appears to be low.

            I had a company who was not notified file a $800 claim.
            They claim is it from a debt they purchased from 1997 (that I have no knowledge over). $310 principle and the rest is interest from 1997 until the date I filed.

            My attorney said there was no use in fighting it as my DMI is what it is and I pay the same either way. The creditors can just fight among themselves as who gets what. So... that is how they get away with it.
