    how soon for repo

    I just filed Ch 13 yesterday and I am surrendering the boat. I paid my last boat payment at the end of August on time......the next payment isn't due until the 29th of September. When do you think the will repo it? The reason I ask is I have to remove some fishing tackle and other personal items. Will the contact me first since I am voluntarily giving it up or will they just come and take it in the middle of the night? What is the standard amount of time I have to get it ready? Thanks

    Even though you're surrendering it, I would think they would have to file a motion to lift the automatic stay before they can take it, but I could be wrong. Someone should be along shortly that knows more about this type of situation.

      Same here. Surrendering a boat and motorcycle and was current on both at time of filing. That was in July. Had 10 year loan on both and only had three years left to pay off. Lawyer said both must go. Continuing insurance and use of both until repo man comes. Hope they contact me first because neither is at my residence!
      Filed July 2009. Discharged 08/08/2014. Awaiting closing. We made it !!!! Woo-hoo!

        They need to first file for relief of the automatic stay. Chances are they will then call your lawyer and arrange for it to be picked up (but once the stay is lifted they could just show and take it if they wanted).

        I have a vehicle lease I am surrendering, I stopped paying in April. The repo man showed up in early June looking for it (I had it hidden in the garage under advise of my attorney, I may not have qualified for CH13 if they had repoed it before I filed).

        As soon as I filed they stopped all collection (including trying to repo it), I still have it now... not sure how much longer until they want it. I get monthly statements in the mail but they just say the account is in BK.
