Thanks everyone...I am doing all that I can...feel like I am just going to lose everything.
I talked to Amex today. The basically told me "You are out of luck unless the divorce court judge awards something."
Amex has a "non-transferable policy." I didn't know this but I will bet my ex did. He had to know...I did find that the disputes were filed with less than 48 hours to go on the 3 month deadline...You have 3 months to file unauthorized use charges...he waited 88 days. And yes I see that Tennessee is not a community property state so I don't understand why they operate as one...All attorneys and even police investigators I have spoken with laughed and said that he couldn't legally do this to me...But no one knows what to say when I say "But he has."
All I wanted to do was take the money he gave me, leave him the house and move on with my life...that's it...but thanks to lots of encouragement I picked myself up, read about how to answer a complaint for divorce, typed one up, filed an affirmative defense and filed a counter complaint. I sent it out on Tuesday express mail and it arrived in his town yesterday...the day before my 30 days to answer were up. I called and they said that they received, accepted and filed it...so apparently I did it right.
The last 6 months of my life has been nothing but chaos and fear...over the most ridiculous things ever...for someone who had an affair and got the house, he is still acting extremely greedy.
I requested in my counter complaint that the court hear proof regarding my authorized use of the card...I have no idea how it's going to end but I'm doing my best.
Surprisingly on Wednesday, the bankruptcy attorney called and left me voice mail...It mentioned wanting to call me back and answer questions that I had, including one about what it would entail for me to convert to chapter 7...
...I left the voice mail asking that question 6 weeks ago.
I haven't called the trustee at all yet. Haven't told the bankruptcy attorney about the 7200.00 bonus either. I did notice on the trustee's site that my husband had missed 3 weekly payments on the 13 though...and when a payment was finally sent in it was only 125.00. (The weekly payment is 260/week.) This may get dismissed without my doing anything.
