    Loan Mod and Ch 13

    Hi All,
    My attorney advised me to seek a loan mod before I file for a Ch13 b/k.
    I have a hiatus from work in May and June but work consistently the remaining 10 months. I need to file before the end of the year to have the two no income months included in the wage calculations, my first is with countrywide/bofa (hope to lein strip the 2nd with Wells Fargo).
    My wife and I are divorcing (two kids), separated almost three years, me living in an apartment, she works part time but was laid up with an injury for almost a year, I can't crack both the nuts for us so here we are.
    Anyone have experience of loan mods with bofa ?
    NOD was filed on 8/20/09. So I have at minimum 3 1/2 months right.
    I live in SoCal

    I was able to modify my loan after filing for Ch 13 and having it confirmed. I was current and my mortgage was paid outside of the plan.

    All I needed was a letter from my attorney to negotiate new terms with bofa.

    Just recently got a loan mod, but it was a long journey to get to this point. I started 12/2008 and I kept on them but once countrywide officially merged with bofa in April, it seems my "approvd" loan mod was lost in the shuffle. With endless calls and going no where I had to start all over again after my ch 13 was confirmed 3 months ago.

    Now I have to bring the loan mod paperwork to bankruptcy court to have them approved the new terms.

    btw, I am in a 100% plan, and it was only for a first mortgage and now second.

      This site will be a good resource, especially regarding a BofA modification. First and foremost, if your are looking for a "Making Home Affordable" (makinghomeaffordable.gov) mod, contact a HOPE counselor to help get started. I don't have the number handy, but it is listed in the FAQ's of the mha wesite.
