    "Notice of Deficient Filing Concerning Certification of Payment Advices"

    I got this notice in the mail yesterday. Supposedly this document is to be filed no later than 45 days after filing your case. I recieved the notice that it was not done and I have until Aug 28th to do so or my case will be dismissed. I called my lawyer yesterday and emailed her today and have not gotten a response. Has anyone ever recieved this notice and what am I supposed to do? My 341 is on Monday.
    $124,000 unsecured debt
    $700 a month for 36 months.
    Case completed 6/15/12, waiting on papers!

    "Certification of Payment Advice" - that would seem to be the responsibility of the attorney, or, if not, then the attorney would be responsible for ensuring that the debtor submitted the required information. Pay Advice is your pay stub or receipt - you cannot possibly have filed for bankruptcy without proving your income for the past 6 months. As far as certification goes - what can you do except swear under penalty of perjury that the pay advice is true and correct on the appropriate form?

    Bring it up at your 341 on Monday.

      Oops! Big mistake! My response above is incorrect for the most part.

      Payment Advice can also be a receipt for a payment the debtor makes to another party.

      Legal jargon can be confusing.
