    Prior 6 months income & affect on C13?

    I have already had my initial consult with the attorney's office & have agreed to do the 13. I've also already paid all the required fees & will be meeting with the actual attorney on the 24th which is when I am supposed to bring in all the paperwork they've listed for me to have and to have filled out.
    My question is this. On that initial consult, I had to take in my pay stubs from the last 6 months, but when I meet with the actual attorney, I am also supposed to bring in my tax returns for the past 2 years. My income for the last couple of years was fairly descent, but due to a cancer diagnosis, my income this year has dropped because I've pretty well lost my commission which was anywhere from 1800-2500 per month. That's why I'm actually in the position I'm in now financially.
    Will the BK trustee look at those last 2 years of tax returns & cause me problems or are they only interested in the last 6 months? The initial person I met with at the attorney's office was a "Debt Counselor" (who is who all initial visits at this office are with), but he didn't mention anything being a problem when he was figuring my income vs. debts. But I was just curious.

      the income look back is 6 months but perhaps your dr could provide proof of your cancer and with current pay stubs, your plan can be designed accordingly. Hope you are well! (or getting that way)

        You shouldn't have any problem about the decline in income, especially with your explanation.

        They're usually only looking for some hint that your income decreased in some attempt to defraud your creditors and/or the Bankruptcy Court.

          We had a higher income on both our tax returns but due to my medical condition, I had to stop working and the income when down dramatically. Our attorney only looked at the last 6 months. It is very tracable and trackable with medical record and documentation if needed so there is no problem.

            Well, mines is not the same as an income decline, but, the 6 months prior to me filing my 2nd mortgage was modified and I was paying alot less. The month after I filed I was due to start making my regular payments (significantly higher than the modified amount) and my lawyer based my plan on the regular higher amount that I would be paying instead of the modified amount previously paid.
