Should I keep paying overdraft protection after closing account?

I will be filing 13 , I close one bank account and opened another at other bank. but still owe about a $1000 in over draft checking account protection at the former bank.Should I keep paying it or just included in bankruptcy filing? If I don't pay it, will it jeopardize the ability of opening another checking account at other banks if I wish to?

You will end up on chexsystems. This will hinder you in the future opening other accounts, but I don't know that it will affect your current account at the bank you have now.

How soon do you plan to file BK? If it is very soon, then just include the amount in your BK.

thank you for the answer . but to be honest with you, I don't know how soon , it is all in the hands of my lawyer. The last time I spoke to him , he said it looked like my payments will be too high for chapter 13, so he rather wait and see other angles and other solutions if he can reduce my monthly payments. The problem is here , I have enough equity in my house to satisfy all my unsecured creditors , but I am not going to walk out my house and give it to them . so as of right now,it is kind of stalemate . My lawyer told me to wait so I am waiting.

Not sure on your states home exclusion, but chances are you will be required at a min to pay your home equity - the states exclusion + value of any other non exempt asset you own. Chapter 13 requires the creditors must get at least what they would get in a liquidation.
