    Has anyone had to turn any money over at/or after your 941?

    money that was unexpected?

    yes...we got the darn bonus AFTER we filed. and our lawyer said keep it, dont' spend it as he expects we will have to turn it over. we did list it on our questinoaire to the trustee. not hiding it or anything.

    just going to suck to turn it over...

    well it depends on your trustee. Hopefully he has a heart. The courts I guess are just swamped right now. Bk filings have SURGED big (most since 2005 law change) so maybe he just doesn't have the energy to deal with it. LOL But you are right, it will suck but at least you still have it and haven't spent it and it is there to turn over instead of having to try and come up with it.

      My Lawyer said the same thing....maybe he will ignore it...with a little chuckle. but you never know as busy as things are in the courts.

        We were over in our property, as well as a preferential payment. $5400 for a year and on the turn (due to a retirement Trust) $5000.

            I was told that I will have to turn over my tax refund from 2008, and pay for some jewelry I bought and gave as a gift, plus they were claiming I had too much equity in my car. However, it has been 3 months since my discharge and they still have not come up with an exact figure. I am sure they are just too busy to get around to this, but I know sooner or later they will demand the money, and in the meantime my case will stay open.

              that is too bad...I would like it to just be overwith. but I thought the jewelry and excess equity would just increase your payment....not actually be paid out of your pocket?

              do you still have your 2008 refund?? or did you spend it?? see I thought when they knew ahead of time they worked it into your income and payment???

              but in our case we found out after we filed

                the poster filed a chapter 7 not a chapter 13 and her case will probably be open for years.
