Just got memo at work Friday stating that our plant will be idled the week of Thanksgiving through the first week of Jan 2010 and possibly longer. Just so happens it is 90 days notice required by government before closing factories. Have a gut feeling I may lose job permanently after 15 years of service. Trustee payments will be taken out of my pay starting September after confirmation hearing, but I will get no paycheck on layoff. I have a waiting week and will collect unemployment til recalled if recalled. Can't make the $1055 Plan payments on unemployment. Should I contact attorney or trustee or both?

You need to contact your attorney with this info, along with a copy of your memo ASAP--well Monday. It is Saturday evening after all. Then if your attorney tends to be the non-responsive sort, mail a letter with a copy of the memo to the Trustee. Mail certified, return receipt please.

Sorry to hear of your job loss. Get in contact with your attorney so that he can ask for your payments to be suspended. They'll generally get them suspended for 90 days, and then reassess the situation after. I just mailed my first payment to the trustee on Aug 6 and thought I was starting the countdown and BAM! My first set back. How revalent would this info be at my 341? Yes. I mailed my first payment before my 341 as per my attorney. I am trying to stay positive and worst case cenario do a chapter 7. The next four months are going to be interesting. Will keep posted on what I am advised to do. Thanks.Filed July 2009. Discharged 08/08/2014. Awaiting closing. We made it !!!! Woo-hoo!

I feel ya! I am going through the same, not technically laid off, but job said dont return from disability as they are not hiring...it sucks all the way around. I am hoing to collect unemployment, but it sure isnt very much! Good luck to you. I hope you can now qualify for a ch7 or reduced payments!

Since you are confirmed, your chapter 13 plan cannot be modified until the event occurs and you have proof in hand to provide to your attorney/trustee. What you need to do is obtain from your employer at that time or when the layoff is officially announced, a statement of what is going on as to you persoally, how long the layoff will last, etc. Our chapter 13 included a clause that indicate we had to make our plan payments even when there was a job loss so you need to provide proof and informatin to your attorney. There is nothing that can be done now as to any modification as you are still working._________________________________________
