    Chap 13 and Retirement funds...

Lets say I place money into roth IRA (retirement fund) would it be
safe from chap 13? or deposits after a certain amount of time
before filing that could not be touched by chap 13?

    Thanks
    David

If you have not been contributing for a while into any retirement plan and just suddenly start socking away money into a retirement plan for the purpose of trying to save the cash from the trustee if you file a chapter 13, trustees can go past the usual six month lookback and go back a year or more if they suspect any sort of fraud. While funds in retirement accounts are exempt from BK, if you were not a saver previously before filing BK, the trustee will take notice of the movement of your money during the look back period prior to filing.
