I do not know anything I am very new to all of this.

I just thought I would mention that when we considered 13 and a cram down it was not to KBB it was a number from a different book our district court uses. KBB said our car was worth 6,900 we owed 13,000 the court FMV was 11,000. (This was for the district that includes Charlotte, NC)

I think different districts must determin the fair market value differently and you might want to make sure how yours does it.

Some Districts use KBB, others use NADA, and still others may use the Black Book. Some Districts only allow the NADA/KBB retail value, others will let you use private party. There just is no consistency at all!

In a chapter 7 that is where the car FMV is financed with a 722 redemption and the rest is discharged. That is what the OP would do to cram down the car in a chapter 7. However you might run into issues with the number of vehicles. If your daughter is an adult and it is her car, then it isn't your responsiblity per say. You might have to deal with that issue. Hopefully your attorney can work around it and get it done for you.
