    Payroll Deduction

    My BK payment is being taken out of my paycheck and I noticed on my last check that the amount that is being taken out decreased $214. My question is: Is the payroll department allowed to change the amount that is being taken out for BK?

    The gross on my last semi-monthly check was shorted by about $350 since we are going to a bi-weekly pay. This shouldn't have anything to do with the reason my BK amount was shorted should it?

    I haven't called my attorney about this yet. I am waiting to see what amount is taken out of my next check before calling (first bi-weekly check), which will be on Friday.

    Bi-weekly vs. semi-monthly adds two more pay periods a year. Does the math work out for the new payment amount to be the same when you consider 26 pay periods a year instead of 24?

      It comes out to be $3400 less per year.

        First, your payroll department is *NOT* permitted to change the amount of your Ch 13 payment stated in your plan. There can be an adjustment for the 'every-other-week' vs 'twice-a-month' payments, but you are saying that the amount your payroll department is sending is short.

        If the payments sent to your trustee are not going to equal what your plan calls for, then you must call your lawyer immediately and discuss what to do about this. It could be a simple payroll error that needs to be corrected right away.

        If the payments sent by your payroll folks do not meet the court's confirmed amount due, then your Ch 13 could be dismissed. You need to get this straightened out, pronto.

          I get paid on Friday, so I plan on calling my attorney if the deduction is less than what it's supposed to be. I don't want to do anything to put my BK in jeopardy of being dismissed.

            I was able to view my paystub and the amount deducted from this check is correct (YAY!). That's one less thing I have to worry about.
