If you are above your state's median income for your household size, then you are 60 months.
If you are below your state's median income for your household size (and you still need to file chapter 13), then you have the option for 36 months. In this case, you get to decide. If there is a reason you need a longer plan (up to 60 months), you can opt for it.
Technically, both attorneys are correct (sort of).
