    who should I list as creditors?

    Hi!!

    I am in the process of filling out the paperwork for a chapter 13 filing. I am a little stumped when it comes to creditors. After so many months I have lost a little oversight on who actually owns the accounts right now. Those accounts have been sold off/handed over/contracted out quite a bit already. Should I just list the OCs and all the third parties that have contacted me in writing as of now? Just the OCs? Or do I actually have to figure out who owns what and who acts on whose behalf?

    List everyone, but if you get duplicate claims you will want to object to them (this is post-filing). You should really get copies of all 3 of your credit reports so you make sure you don't miss anybody. You can get them free if you haven't requested on in more than a year, if you have to pay for them, it's ~$30 for all three I think. It's $26 for each creditor you forget and have to add later, so you'd still probably be better off getting your credit reports even if you have to pay for them. Good luck!

    Plan Modified July 8, 2009 from $1100/month to $400/month due to change in income, finally discharged in July of 2013!

      You can also get another copy of reports if you have gotten adverse action from a creditor in the last 60 days (credit line decrease, APR increase, account closure, etc.)... not hard to qualify for when you are close to BK!

        Watch listing your utilities. You could get a nasty surprise like we did. You may have to put up to $400 dollars down as a security deposit.(for claiming them in your Bankruptcy) Ask your Lawyer before listing them.
